Terms and Conditions – Instagram Giveaway “Protein Advent Calendar”
§ 1 Organizer
(1) The organizer of the “Protein Advent Calendar” giveaway (hereinafter referred to as the “Giveaway”) is IronMaxx® Nutrition GmbH & Co. KG, Rheinpromenade 10, 40789 Monheim am Rhein, Germany (hereinafter referred to as “IronMaxx” or the “Organizer”).

(2) The Giveaway will be conducted on the Instagram platform, both through the account @ironmaxx_nutrition (main giveaway) and through the accounts of creators commissioned by IronMaxx (creator giveaways). These Terms and Conditions apply equally to all parts of the Giveaway.
(3) By participating in the Giveaway, participants accept these Terms and Conditions.
§ 2 Eligibility
(1) Participation is open to natural persons who are at least 18 years of age and have their place of residence and a delivery address in the Federal Republic of Germany.
(2) Employees of IronMaxx and their relatives, the creators involved in conducting the Giveaway and their relatives, as well as individuals who use unauthorized means or otherwise gain an advantage through manipulation, are excluded from participation.
(3) Participation is only possible with a personal Instagram account that must remain publicly visible throughout the Giveaway period and until the winners are drawn. IronMaxx reserves the right to request proof of age and residence before handing over the prize. If such proof is not provided, the prize will be forfeited. Entries submitted through fake accounts, multiple accounts, or so-called giveaway accounts are excluded. IronMaxx reserves the right to disqualify such accounts from participation and the winner selection process.
§ 3 Participation Period and Entry Requirements
(1) The main Giveaway begins on November 6, 2026, at 5:00 PM. The creator giveaways begin on November 8, 2026, with the publication of the respective giveaway post. The closing date for all parts of the Giveaway is November 20, 2026, at 11:59 PM (CET). Entries submitted after this deadline will not be considered.
(2) To participate, participants must, during the Giveaway period:

Follow the Instagram account @ironmaxx_nutrition. For creator giveaways, participants must also follow the respective creator's account; and

Leave a comment under the respective giveaway post tagging two additional people.
(3) Each person may enter each giveaway post only once. Multiple comments submitted by the same person will be counted as a single entry.
(4) Participants may also receive one bonus entry by sharing the giveaway post in their Instagram Story and tagging @ironmaxx_nutrition. For creator giveaways, the respective creator must also be tagged. Only Stories that are visible to @ironmaxx_nutrition will be counted. Stories shared with “Close Friends,” through a private profile, or with restricted visibility settings cannot be considered.
IronMaxx will document Story tags by taking screenshots during the Giveaway period, as Stories disappear after 24 hours. This documentation will serve as the basis for awarding the bonus entry.
Sharing the post in a Story is voluntary and is not a requirement for participation. A maximum of one bonus entry will be awarded per person per giveaway post. The bonus entry doubles the participant's chances of winning.
(5) Participation is free of charge and is not dependent on the purchase of any goods or services. Purchasing a product does not increase the chances of winning.
§ 4 Prizes
(1) In the main Giveaway on @ironmaxx_nutrition, two IronMaxx Protein Advent Calendars 2026 will be raffled off. Each winner will receive one calendar.
(2) One IronMaxx Protein Advent Calendar 2026 will be raffled off in each creator giveaway.
(3) Cash redemption, exchange, or transfer of the prize to another person is excluded. IronMaxx reserves the right to replace a prize with an equivalent prize if the original prize is no longer available.
§ 5 Winner Selection and Notification
(1) Winners will be selected at random from all valid entries on November 21, 2026. Bonus entries will be counted as additional entries in the draw.
(2) Winners will be notified via Instagram Direct Message by the account through which the respective Giveaway was conducted. The winner's Instagram username may be published in an Instagram Story or post, provided that the winner gives their consent.
(3) If a winner does not respond within 7 days of being notified, providing their full name and delivery address, their entitlement to the prize will expire and a new winner will be selected.
(4) Recourse to the courts regarding the winner selection process is excluded.
(5) Beware of fake accounts: IronMaxx will contact winners exclusively through @ironmaxx_nutrition or the official account of the respective creator. IronMaxx will never request payments, fees, card details, passwords, or clicks on external links. Messages from other accounts impersonating IronMaxx are fake and should be reported and blocked.
§ 6 Delivery of Prizes
(1) IronMaxx will send the prizes by post to the delivery address in Germany provided by the respective winner. This also applies to prizes awarded through the creator giveaways.
(2) IronMaxx will cover the shipping costs. IronMaxx shall only be liable for damage or loss occurring during shipment due to the actions of the shipping service provider in cases of intent or gross negligence.
§ 7 Disqualification from Participation
(1) IronMaxx reserves the right to disqualify participants who violate these Terms and Conditions, provide false information, use unauthorized means (e.g. bots or automated comments), or otherwise manipulate or attempt to manipulate the Giveaway.
(2) Comments or Story content that is offensive, discriminatory, unlawful, or otherwise inappropriate will also result in disqualification.
(3) If the conditions for disqualification are met, any prize already awarded may also be revoked and reclaimed retrospectively.
§ 8 Early Termination and Changes
(1) IronMaxx reserves the right to suspend, modify, or terminate the Giveaway, in whole or in part, at any time without prior notice and without stating reasons, if its proper execution cannot be guaranteed for technical, legal, or other reasons (e.g. in cases of manipulation, disruptions to the Instagram platform, or force majeure).
(2) Participants shall have no claims against IronMaxx arising from any early termination or modification of the Giveaway.
§ 9 Data Protection
(1) The data controller responsible for processing personal data in connection with the Giveaway is IronMaxx® Nutrition GmbH & Co. KG, Rheinpromenade 10, 40789 Monheim am Rhein, Germany. The Data Protection Officer can be contacted at datenschutz@ironmaxx.de.
IronMaxx processes participants' Instagram usernames, publicly available participation content (comments and tags), and, in the case of a Story share, a screenshot of the Story. For winners, the content of direct messages, their full name and delivery address, as well as any information required as proof under § 2, will also be collected.
(2) This data will be used exclusively for the administration of the Giveaway, notification of winners, and delivery of prizes. It will be deleted after the Giveaway has concluded and the prizes have been handed over, but no later than three months after the winner selection, unless statutory retention obligations require otherwise.
Personal data will not be shared with third parties for advertising purposes. The legal basis for processing is Art. 6(1)(b) GDPR (performance of the Giveaway as a contractual or quasi-contractual relationship).
(3) For creator giveaways, the respective creator will forward the winner's name and delivery address to IronMaxx for the purpose of shipping the prize. No further data will be shared with third parties, except with the shipping service provider responsible for delivery.
(4) Participants have the right to access, rectify, erase, and restrict the processing of their personal data, as well as the right to data portability and the right to object.
Participants may withdraw from the Giveaway at any time by deleting their comment or sending an email to datenschutz@ironmaxx.de.
Participants also have the right to lodge a complaint with a data protection supervisory authority, for example, the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia.
Participation takes place via Instagram, a service provided by Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, D04 X2K5, Ireland. The processing of personal data by Instagram is governed by Meta's Privacy Policy.

§ 10 Liability
(1) IronMaxx shall be liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence.
(2) In all other cases, IronMaxx shall only be liable for breaches of essential contractual obligations and such liability shall be limited to foreseeable damages typical for the contract. IronMaxx shall not be liable for disruptions or outages of the Instagram platform or for the loss of entries due to technical problems beyond IronMaxx's control.
(3) Upon handing over the prize to the shipping service provider, IronMaxx shall be released from all obligations, unless liability arises under the preceding paragraphs.
§ 11 No Affiliation with Instagram
This Giveaway is in no way affiliated with Instagram, Meta Platforms, Inc., or Meta Platforms Ireland Ltd., and is neither sponsored, endorsed, nor organized by Instagram.
IronMaxx is the sole point of contact for all questions relating to the Giveaway.
By participating, participants release Instagram and Meta from any and all claims arising in connection with the Giveaway.
§ 12 Final Provisions
(1) The laws of the Federal Republic of Germany shall apply.
(2) Recourse to the courts is excluded.
(3) Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
